OFFICIAL RULES
VOID WHERE PROHIBITED OR RESTRICTED BY LAW. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Contest is open only to U.S. residents physically residing in the 48 contiguous United States and DC (residents of Alaska, Hawaii, Guam, Virgin Islands, Puerto Rico and other U.S. territories are excluded from entry and participation), who are 18 years of age or older as of March 19, 2007. Contest begins on March 19, 2007, and ends at 11:59 p.m. EDT on May 1, 2007 ("Contest Entry Period"). This Contest is sponsored by The Bantam Dell Publishing Group, a division of Random House, Inc. ("Sponsor").
ELIGIBILITY:
The following persons are not eligible to participate: Employees, officers and directors of Random House, Inc. and its subsidiaries, affiliates and advertising and promotion agencies involved with this Contest; the Contest judges; and the immediate family members and/or those living in the same household of each of the above. By participating, entrants agree to be bound by these Official Rules and the decisions of the representatives of the Sponsor who will be judging the entries and/or any other sponsors, which are binding and final on matters relating to this Contest.
HOW TO ENTER:
1) Create a video trailer that is thirty (30) seconds long (see Video Requirements below). You must also follow the instructions to download the excerpt of THE GOOD GUY as well as materials that must be included as part of your final video. For your entry to be valid, you must acknowledge reading, accepting, and agreeing to the terms as set forth in these Official Rules.
(2) Visit www.thegoodguytrailercontest.com to register and complete the Official Entry form in its entirety (including your name, daytime telephone number, address, city, state, zip code, date of birth, email address and, if applicable, your YouTube handle).
(3) Following registration at www.thegoodguytrailercontest.com you will receive instructions directing you to http://www.youtube.com/group/goodguytrailer where you must upload your video, using the same email address or YouTube handle as you used in your Official Entry form on www.thegoodguytrailercontest.com, in order to be eligible to win. All online entries must be registered and posted by 11:59 p.m. EDT on May 1, 2007, BUT NOTE THAT THEY WILL BE REVIEWED ON A ROLLING BASIS AS THEY ARE RECEIVED.
VIDEO REQUIREMENTS:
Create a thirty-second (0:30) video trailer ("Video") using your own ORIGINAL footage and the cover image/end-shot requirements posted at www.thegoodguytrailercontest.com. Before you start, please read these Official Rules, including the Terms of Submission (below), carefully. Entries will be judged on originality (30% of score), creativity (30% of score), and ability to generate interest in reading the rest of THE GOOD GUY by Dean Koontz (40% of score) (see judging details below).
Your Video must be original and unpublished. See below for complete Terms of Submission.
LIMIT ONE ENTRY PER PERSON. Entries generated by script, macro or other automated means are void. All entries become the property of Sponsor and will not be acknowledged or returned.
VIDEO TRAILER REQUIREMENTS:
Your Video must consist of a trailer satisfying the following requirements:
(a) The Video must promote THE GOOD GUY by Dean Koontz, enticing readers to discover a truly outstanding reading experience. All filmmakers must download the excerpt of THE GOOD GUY at www.thegoodguytrailercontest.com, and base their ideas off the material provided.
(b) The Video must successfully communicate the genre and tone of the book. Depiction of character, setting and plot should be consistent with the book's depiction of character, setting and plot. However, the Video is not required to dramatize any specific scene in the book.
(c ) The Video must focus on the content of the book itself. It cannot, for example, be themed around the author, pre-publication or overseas book sales, or film right options.
(d) The Video must be exactly thirty seconds (0:30) in length, of which the final five seconds (0:05) must feature the cover image and web url provided for download at www.thegoodguytrailercontest.com. The cover image cannot be changed or manipulated in any way.
TERMS OF SUBMISSION:
Originality: You represent and warrant that your Video is your original work and does not contain any third-party music or other third-party content or other materials (such as writing, poetry, text, graphics, artwork or logos), or any inappropriate or offensive materials. If you include any music in your Video, you further represent, warrant and guarantee to the Sponsor that the compositions, recordings, lyrics, text and other musical materials contained in the Video are original, created only by you and do not contain any "samples" or excerpts that would infringe on the copyrights of others, is not merely a "cover" of someone else's song and that you have not granted to any third party or entered into any type of agreement including an exclusive recording agreement that would grant that third party any types of rights to your recorded performances. If you include artwork in your Video, you further represent, warrant and agree to the Sponsor that it is your original creation, created only by you and it does not contain any pre-existing elements that would infringe on the copyrights of others, except that you make no representations or warranties with respect to the end-shot materials provided by Sponsor.
Any Videos containing material that is violent, pornographic or otherwise obscene, illegal, racially or morally offensive, or defamatory, as determined by Sponsor, in its sole discretion, may be rejected as ineligible for judging. Entries must comply with all laws, rules, and regulations including, but not limited to, those concerning copyright, plagiarism, trademark, defamation and invasion of privacy.
People Appearing in the Video: If the Video contains the image, likeness, voice, name or other identifying characteristic of any third party, you represent, warrant and agree that you have the written permission from such third party to grant the right to use of his/her image, likeness, voice, name and/or other identifying characteristic in the manner authorized under these Official Rules (as described below). In addition, and without in any way limiting the foregoing, if you submit an image of someone who is under 18 years of age, you must be that child's parent or legal guardian.
BY ENTERING, YOU AGREE THAT: (i) all Videos become Sponsor's property and will not be returned, and (ii) Sponsor has the right to alter and/or edit the Video or any part or element thereof in its sole discretion. YOU FURTHER AGREE THAT, by submitting your Video to us, you are at such time irrevocably assigning to Sponsor, its affiliates, and its licensees, successors and assigns all rights, title and interest (including but not limited to, the copyright, all rights to prepare derivative works, all goodwill and all moral rights) in and to the Video and in and to any and all literary and cinematic elements of the Video utilized by you, including but not limited to ideas, concepts, themes, plots, formats, characters, portrayals, voices, costumes, settings, scenes and depictions ("Video Materials"). Without limiting the foregoing, you expressly grant Sponsor, its promotional and advertising agencies, and its licensees, successors and assigns the right to use all or part of your Video for future advertising, promotion and publicity in any manner and in any medium now known or hereafter devised throughout the world in perpetuity. You grant the Sponsor these rights whether or not you are selected as a Winner. YOU WILL NOT BE PAID FOR YOUR VIDEO or for granting Sponsor any of these rights. Sponsor, its affiliates, and its licensees, successors and assigns are in no way obligated to use your Video (and have no obligation to you or any other person or entity after your Video is received), and you may or may not not be given any credit if your Video is used. Sponsor may elect to post any, all, or none of your Video on www.thegoodguytrailercontest.com or at another URL at Sponsor's discretion. If Sponsor does elect to use your Video or any part thereof, Sponsor may remove all or any part of it at any time for any or no reason, and Sponsor may use all or any part of it in any way that Sponsor elects, in its sole discretion. You agree to waive all claims to and shall receive no royalties of any kind now or in the future from Sponsor, its affiliates, or its licensees, successors and assigns for use of your Video on bantamdell.com, randomhouse.com, youtube.com, or otherwise, including copyright, trademark, public performance, digital sound recording, mechanical, synchronization or master use royalties, and you represent, warrant and agree that no other party is entitled to claim royalties from the use of the Video as set forth in these Official Rules. You further release Sponsor and all third parties from any and all claims, demands and liabilities of every kind whatsoever, known or unknown, which may arise in relation to the use of material similar to the Video Materials by Sponsor, its affiliates, or its licensees, successors an assigns or by reason of any claim now or hereafter made by you. Please also be aware that your Video may not be acknowledged and will not be received or held "in confidence" and your Video does not create a confidential relationship or obligation of secrecy between you and Sponsor, any of its affiliates or any of its licensees, successors or assigns. You may not resell, assign or transfer any of your rights under these Official Rules.
All rights in and to THE GOOD GUY by Dean Koontz (including but not limited to the rights to prepare derivative works) are retained by Dean Koontz and/or his licensees and assigns.
By entering your Video, you acknowledge that you have read and understood these Official Rules, and you accept these Official Rules together and agree to abide by its terms and conditions, and all other applicable rules and regulations. Additionally, you agree that you have all rights, approvals and/or consents necessary to submit the Video on the terms provided in these Official Rules and your Video does not violate the rights of any other person or entity or any law.
SELECTION OF WINNERS: Beginning on March 19, 2007, each eligible Video will be reviewed by qualified judges as assigned by the Sponsor ("Judges") who will review Videos on a rolling basis, as they are submitted, up until the entry deadline. The Contest Winners will be selected on or around May 4, 2007. The decisions of the Judges are final and not subject to challenge or appeal.
All entrants who comply with these Official Rules and submit eligible Videos will receive a free t-shirt for participating in the Contest.
PRIZE: One (1) Grand Prize winner will be selected by the Judges (the "Grand Prize Winner"). Entries will be judged on originality (30% of score), creativity (30% of score), and ability to generate interest in reading the rest of THE GOOD GUY by Dean Koontz (40% of score). All judges' decisions are final. The Grand Prize Winner will, at Sponsor's sole discretion, have his/her Video aired as part of THE GOOD GUY advertising campaign in pre-roll video format, as placed by the Sponsor in its discretion, and posted on the official Dean Koontz website, www.thegoodguytrailercontest.com. The Grand Prize Winner will also receive a cash prize of Five Thousand Dollars ($5,000) and a set of five (5) Dean Koontz novels, each of which is a limited, signed, numbered collector's edition. Total value: Approximately Six Thousand Dollars ($6,000). Two (2) First Place winners will be selected by the Judges according to the same judging criteria set forth above. Each of the two First Place winners will have his/her video posted on the official Dean Koontz website at Sponsor's discretion and each will receive a set of five (5) Dean Koontz novels, each of which is a limited, signed, numbered collector's edition. Total value: Approximately One Thousand Dollars ($1,000). The Winners will be notified by telephone or e-mail on or around May 7, 2007, and will be required to execute an Assignment of Copyright, an Affidavit of Eligibility, and a Publicity/Liability Release, to be returned within seven (7) days of such notification. In the event of noncompliance with the foregoing requirements or if any prize or prize notification is returned as undeliverable, the prize will be forfeited and, at Sponsor's discretion, an alternate winner will be selected. In the event that insufficient qualified entries are received, Sponsor reserves the right, in its sole discretion, to not award all prizes. Prizes are not transferable any may not be substituted or redeemed for cash, except at Sponsor's sole discretion.
OTHER TERMS: Sponsor, its parents, subsidiaries and affiliates, its licensees, successor and assigns (collectively, "Released Parties") are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, damaged, incomplete, incorrect, misrouted, undelivered, garbled, illegible or postage-due mail, entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failures or difficulties, or other errors of any kind whether human, mechanical, electronic, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes or any Contest-related materials; or the incorrect or inaccurate capture of any entry or other such information or the failure to capture any such information. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in the Contest or downloading materials from or use of Sponsor's web sites and www.deankoontz.com. Persons who tamper with or abuse any aspect of the Contest or the websites of Sponsor or its affiliates, as solely determined by Sponsor, will be disqualified. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH PERSON FROM THE CONTEST, IF APPLICABLE).
Should any portion of the Contest be, in Sponsor's sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of Sponsor, corrupt or impair the administration security, fairness or proper play, or submission of entries, Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest in any manner, in Sponsor's sole discretion, and conduct judging from amongst all eligible, non-suspect entries received prior to action taken. Entrants, by participating, agree that Released Parties and their respective parents, affiliates, subsidiaries, dealerships, advertising and promotion agencies, and website providers/web masters, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or participation in this Contest. Each winner, by acceptance of a prize, except where legally prohibited, grants permission to Sponsor and its designees to use his/her name, address (city and state), photograph, voice, and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having used the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider or other organization responsible for assigning e-mail addresses.
CONDITIONS: By entering this Contest, entrants release and agree to hold harmless Sponsor, its parents, subsidiaries and affiliates, its licensees, successors and assigns, its promotional and advertising agencies, as well as the officers, directors, employees, representatives and agents of each of the foregoing entities, from any and all damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of an entrant's Video and/or its contents or by reason of the acceptance, possession, use or misuse of any prize or participation in the Contest. These Official Rules are governed by the State of New York without regard to choice of law rules. These Official Rules cannot be modified or waived except in writing and unless properly signed.
WINNERS' LIST: For names of the winners, send self-addressed, stamped envelope to The Good Guy Trailer Contest, Bantam Dell Publishing Group, 1745 Broadway, New York, NY 10019, by May 31, 2007. Vermont residents may exclude postage.
